Terms of Service

1. Acceptance of Terms

By creating a Giftly account or using the Giftly service ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Giftly helps employers send personalized gifts to their employees on birthdays, work anniversaries, and selected holidays. Gifts are sourced and shipped on the employer's behalf based on a budget the employer sets and preferences the employee provides.

3. Accounts & Eligibility

You must be at least 18 years old and authorized to make purchases on behalf of your organization. You are responsible for keeping your credentials confidential and for all activity under your account.

4. Wallet, Fees & Refunds

Giftly operates a prepaid wallet. Funds added to your wallet are used to (a) pay your platform subscription, (b) cover the cost of gifts and shipping, and (c) cover any per-employee fees. Wallet balances are non-transferable. Unused balances are refundable to the original payment method on written request, less any fees already incurred.

5. Gift Selection & Cancellation Window

Giftly's algorithms suggest gifts based on the preferences your employees submit. You will be notified of each upcoming gift at least three (3) days before it is purchased. You may cancel any planned gift from your dashboard during that window. Once a gift is ordered, it cannot be cancelled.

6. Subscription

Plans are billed in advance and renew automatically unless cancelled before the renewal date. Per-employee fees accrue based on the number of active employees on the plan during the billing period.

7. Acceptable Use

You agree not to use Giftly to ship items that are illegal, hazardous, or violate the rights of any person. You will not attempt to disrupt the Service or access data you are not authorized to access.

8. Limitation of Liability

To the fullest extent permitted by law, Giftly's aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid to Giftly in the twelve (12) months preceding the event giving rise to the claim.

9. Termination

You may close your account at any time. We may suspend or terminate your account for violation of these Terms. On termination, any remaining wallet balance will be refunded subject to Section 4.

10. Changes

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect.
